Writ Petition No.24311 of_2008
In this Writ Petition, it is the grievance of thepetitioner that even though notices under Sections 452and 636 of the Hyderabad Municipal Corporation Act,were issued to the third respondent in view of theunauthorized constructions made by her, no furthersteps for demolition thereof have yet been taken byrespondent Nos.1 and 2.
On written instructions issued by the secondrespondent-Assistant City Planner, Circle-4, GreaterHyderabad Municipal Corporation, videLr.No.44/ACP/C4/GHMC/2008, dated 22-11-2008, it issubmitted by learned Standing Counsel for respondentNos.1 and 2 that after issuance of the abovesaidnotices, the third respondent filed O.S.No.3229 of 2008on the file of the City Civil Court, Hyderabad, andobtained interim order against respondents Nos.1 and 2in I.A.No.372 of 2008 filed therein.
In view of the interim order passed by the civilCourt in I.A.No.372 of 2008 in O.S.No.3229 of 2008 filedby the third respondent, no direction for removal of unauthorized constructions made by her can begranted at this stage. However, it is open for thepetitioner to implead himself in the abovesaid suit, if heis affected party, and seek vacation of the said interimorder.
The Writ Petition is, accordingly, closed. Thereshall be no order as to costs.
