the Negotiable Instruments Act, 1881. The learned counsel for thepetitioner relied on the ratio laid down in K.Bhaskaran v, SankaranVaidhyan Balai in support of his contentions.
8 On the other hand, the learned counsel for the first respondentthe other hand, the learned counsel for the first respondentother hand, the learned counsel for the first respondenthand, the learned counsel for the first respondentthe learned counsel for the first respondentlearned counsel for the first respondentfor the first respondentfirst respondentrespondentcontended that both the courts below have concurrently held that thepetitioner failed to establish the guilt of the first respondent beyondreasonable doubt and have rightly acquitted the first respondent of thealleged offence, Therefore, the [judgments ]of both the coufts below do notwarrant any inteference of this Court.
On the other hand, the learned counsel for the first respondentthe other hand, the learned counsel for the first respondentother hand, the learned counsel for the first respondenthand, the learned counsel for the first respondentthe learned counsel for the first respondentlearned counsel for the first respondentfor the first respondentfirst respondentrespondent 9 As seen from the record, both the courts below have held that thepetitioner failed to produce the promissory note in order to establish thetransaction. The [petitioner ]also failed to produce the income tax returnsto show that he has such capacity to lend money to the first respondent. Both the courts below have categorically held that the first respondent hassucceeded in rebutting the presumption under Section 118-A of N.l. Act.The first respondent has successfully rebutted the presumption underSection 139 of the N.l. Act that the cheque was issued not in connectionwith any legally enforceable debt. The first respondent has successfullyestablished that there are several money transactions between him andthe petitioner and that the subject cheque was issued in connection withsome other transactions, which the petitioner failed to disprove. The facts of the case in K.Bhaskaran (r supra) reried on by the rearned counser(r supra) reried on by the rearned counser for the petitioner are not applicable to the case on hand.
10 For all the above reasons, I am of the considered view that thepetitioner failed to prove the guilt of the first respondent beyond allreasonable doubt. Hence I do not incline to interfere with the wellconsidered judgments of both the courG below.
11 Accordingry, this criminar revision case is riabre to be and isdismissed as devoid of merit.
