ORDER:

This Court, while disposing of Writ Petition No.23413 of 2009 filedby the petitioner directed the respondent authorities to consider therepresentation if any given by the petitioner or otherwise directed thepetitioner to give a fresh representation within a period of two weeks fromthe date of the order and the respondent authorities were further directedto consider the said representation and pass necessary orders. According to the petitioner he gave a representation to the respondentauthorities on 31.10.2009 and hence he did not give a furtherrepresentation, but, however, as the said representation dated31.10.2009 has not been considered and no orders have been passed. Hence he approached this court and filed the present Writ Petition statingthat the authorities proceeded on the assumption that the petitioner hasnot given any representation pursuant to the orders passed by this Courtin the said Writ Petition.

Heard both sides.

Writ Petition No.23413 of 2009 was disposed of with a direction tothe respondents to consider the representation if already given by thepetitioner or otherwise the petitioner was directed to give a representationafresh within a period of two weeks from the date of the order if notalready given. When once it is the contention of the learned counsel forthe petitioner that a representation dated 31.10.2009 has already beengiven by the petitioner, question of giving a fresh representation does notarise and the order stating that the petitioner has not given anyrepresentation within a period of two weeks pursuant to the directiongiven in the earlier writ petition does not arise.

Accordingly this writ petition is disposed of with a direction to therespondent authorities to consider the said representation dated 31.10.2009 given by the petitioner and pass appropriate orders thereonwithin a period of two weeks from the date of receipt of a copy of this order. No order as to costs.
