ORDER
The present criminal petition is flled under Section 482 Cr.p.C.seeking to quash the proceedings in crime No.361 0f 2020 0nthe fire ofPS Mancheriar rown' Mancheriar District, Ramagundam commissionerate,registered for the offences punishabre under section 420 and5o6 Ipc,wherein the petitioner herein is arrayed as the sole accused,2. The criminal petition is taken up for hearing today, i.e. 30.12.2020,through Video Conferencing.
3' Heard rearned counser for the petitioner and rearned AdditionarPublic [prosecutor ]appearing for respondent No.1 _ State.4. Learned counsel for the petitioner would submit that though thepresent criminar petition is fired seeking quashing of the proceedings inCrime No.361 of 2O2O registered by respondent No.1 authority, however,is restricting the relief sought for in the present quash pefltion to the onefor issuing a direction to the respondent authority to forow the procedureprescribed under Section 41-A Cr.p.C. and the guidelines laid down by theHon'ble Apex Court in ARAIESH KUMAR V/s. STATE OF BIHAF.5. Learned Additional public prosecutor would submit that therespondent authorities would follow theprocedure prescribed underSection 41-A Cr.p.C.6Having regard to the submissions made as above, since the offencewhichthe petitioners arecharged with being punishable withrmprisonment of less than seven years, the respondent investigatingagency is directed to follow the procedure prescribed under Section 41-A
