THE HON’BLE SRI JUSTICE L. NARASIMHA REDDY

WRIT PETITION No. 26204 OF 2005

DATED: 26.12.2005

Between:

Kaza Naga Harika.

… PETITIONER

AND

The Government of Andhra Pradesh, Rep. By its Secretary, Higher EducationDepartment, Secretariat, Hyderabad. and others … RESPONDENTS

ORDER:

The petitioner was admitted in B.Pharmacy Course in the 6[th] respondent-College. She made certain allegations against the College in relation to itsfunctioning. Ultimately, she wanted to join another college after obtainingTransfer Certificate. In this Writ Petition, she claims the relief of a declarationthat the inaction of respondents 1 to 5 in monitoring the functioning of the 6[th]respondent-College is illegal, arbitrary and seeks a consequential direction tothe 6[th] respondent-College to issue Transfer Certificate as well as No ObjectionCertificate.

When the Writ Petition came up for admission on 08.12.2005, Notice BeforeAdmission was ordered and the counsel for the petitioner was permitted to takeout notice to the 6[th] respondent.

Today, the learned counsel for the 6[th] respondent-College made submissionsafter obtaining instructions. He submits that the petitioner made severalallegations without any basis, and in case, she is prepared to withdraw them, the College has no objection to issue Transfer Certificate.

The learned counsel for the petitioner, after obtaining instructions from hisclient, submits that the petitioner is ready to withdraw the objections, in casethe 6[th] respondent-College is prepared to issue the Transfer Certificate as wellas No Objection Certificate.

With the submissions made by the learned counsel for the petitioner and thelearned counsel for the 6[th] respondent-College, the controversy in this Writ Petition gets substantially narrowed down. The 6[th] respondent has expressedits willingness to issue Transfer Certificate as well as No Objection Certificate, subject to certain conditions, which are acceptable to the petitioner.

Hence, the Writ Petition is disposed of, directing that the 6[th] respondent-College shall issue Transfer Certificate as well as No Objection Certificate tothe petitioner, and she, in turn, shall submit a memo to the 6[th] respondent-College stating that she withdraws all the allegations made by her against theInstitution. This exercise shall be completed within a period of one (1) weekfrom the date of receipt of a copy of this order. There shall be no order as tocosts.
