O R D E R:

The petitioner states that he has been appointed as Conductor, on daily wagebasis, on 02-04-1994, and alleges that several conductors, who were appointedalong with him and are juniors to him, have been regularized. He placesreliance upon the order, dated 18-08-2004 passed by this Court inW.P.No.16244 of 1999.

Heard the learned counsel for the petitioner and learned Standing Counsel forthe respondents.

In DIVISIONAL MANAGER, APSRTC v. P.LAKSHMOJI RAO, the SupremeCourt dealt with the rights of the conductors and drivers, appointed on dailywage basis. After taking the various aspects into account, the Supreme Courtdirected that if any conductors, who are junior to the respondent therein, in therelevant seniority list of the concerned Division or Region, have been extendedthe benefit of seniority and regulation, the Corporation shall extend the samebenefit to the employees, who are seniors to those who are regularized. Thejudgment of the Supreme Court was followed by this Court in WP.No.16244 of1999.

In that view of the matter, the writ petition is disposed of, directing that in caseany conductors, who are appointed on daily wage basis along with the petitionerand are juniors to him, have been regularized, the same benefit shall beextended to the petitioner also. An order in this regard shall be passed, withintwo months from the date of receipt of a copy of this order. There shall be noorder as to costs.
