ORDER:

1. This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct respondents Nos.3 and 4 to register a crime against the unofficial respondents.

2. Heard and perused the material available on record.

3. It is stated in the affidavit that the unofficial respondents and some other persons are acting illegally and they entered into the petitioner-church, beat the Chairman, took away all the offerings and the books relating to the petitioner-Church. Even though a complaint was given to the official respondents, they did not take any action.

4. Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

“The petitioner is directed to lodge a fresh complaint before the police station concerned and on such complaint, the police concerned are directed to register a case, if it discloses a cognizable offence.”

5. With the above direction, the Writ Petition is disposed of. No costs.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
