JUDGMENT:-

The application is filed by the petitioner to quash the orders inCrl.M.P.No.324 of 2011 in M.C.No.8 of 2009 dated 20.06.2011 on thefile of the Judicial Magistrate of First Class, Palasa, SrikakulamDistrict.

The petitioner herein filed a claim for maintenance and thehusband has set up a plea that one Dr.A.K.Thakur has been treatinghis parents and who has issued some bills and they are to be proved.

In the very facts and circumstances of the case, the question oftreatment to the parents of the respondent may not be relevant forconsideration of the claim for maintenance. However, in view of thefact that the lower Court was pleased to appoint an Advocate-Commissioner and as this application is one for maintenance itself, theexpenditure for the revision petitioner and her counsel to be taken tothe place where the doctor is to be examined shall be borne by therespondent, who is the husband of the revision petitioner.

Accordingly, the Criminal Revision Case is disposed of at thestage of admission.
