ORDER:
This petition is filed under Section 482 Cr.P.C. to quash theproceedings against the petitioners/accused Nos.1 to 5 in C.C.No.110of 2015 on the file of the Court of the Judicial First Class Magistrate atHuzurnagar, Nalgonda District.
The learned counsel for the petitioners seeks permission of thisCourt to permit the petitioners to withdraw the criminal petition withliberty to avail the remedies available to them under law includingfiling of a petition for discharge, if charges are already not framed.Hefurther submitted that the presence of petitioner Nos.2 to 5 may bedispensed with before the trial Court.
Permission is granted.
There is no dispute with regard to the identity of petitioner Nos.2to 5.Even if their presence is dispensed with, no prejudice will becaused to the second respondent.
Hence, the Criminal Petition is dismissed as withdrawn grantingliberty as prayed for.The presence of petitioner Nos.2 to 5, who areaccused Nos.2 to 5 in C.C.No.110 of 2015, before the trial Court ishereby dispensed with on each and every date of adjournment.However, they shall appear before the trial Court as and when theirpresence is so required.
Consequently, Miscellaneous Petitions, if any, pending in thisCriminal Petition, shall stand closed.
