THE HON’BLE SRI JUSTICE L.NARASIMHA REDDY

W.P.No.28061 of 2005

Date:30.12.2005

Between:

A.Rajanna

-------PETITIONER

AND

Sarada Vidyaniketan and others

---------RESPONDENTS

ORDER:

The petitioner states that he was initially appointed as L.D.C. in the first respondent-school and was later appointed as teacher in 1996 on acquiring B.Ed. qualification. He contends that an aided post of School Assistant is remaining vacant in the firstrespondent-school and that though he made number of representations in thisregard, no action has been taken for absorbing him against the said vacancy.

Heard the learned counsel for the petitioner and the learned Government Pleader forSchool Education.

Even assuming that an aided post of teacher is remaining vacant in the firstrespondent-school, the petitioner cannot have any independent right against it,unless the management has submitted the necessary proposals. An unaidedteacher in a school does not have the right to insist that he must be absorbedagainst an aided vacancy. Therefore, the petitioner has to work out his remediesagainst the management.

The writ petition is accordingly disposed of, leaving it open to the petitioner to makea necessary representation to the first respondent, who, in turn, shall take the same into account, and intimate the petitioner of the outcome of such consideration. Thereshall be no order as to costs.
