ORDER:

The petitioners who claim to be owning lands adjacentto the land over which an electrical sub-station is proposedto be constructed in Sy.No.309/1 of Pasalpudi village,Rayavaram Mandal, East Godavari District, filed this WritPetition on apprehension that there is a likelihood ofelectrical lines being drawn over the lands belonging tothem, affecting their agricultural activity.

In the counter-affidavit filed by respondent No.5, hehas categorically stated that the sub-station is beingproposed to be constructed over an extent of Ac.0-48 centsof land in Sy.No.309/1 belonging to Smt. Karri Lakshmi w/o.Venkata Reddy and donated to APEPDCL for constructionof a sub-station. The counter-affidavit also dispelled theapprehension of the petitioners that the electrical line maybe erected over their lands if the sub-station is constructed. It is also categorically stated that the poles and the electricalwires will be located along the public road (Puntha road) andthe same will not be taken through the petitioners’ lands.

At the hearing, Sri Gani Reddy, learned counsel forthe petitioners, stated that if the electrical lines do not passover the petitioners’ lands, they have no objection for construction of the proposed sub-station.

In the light of the contents of the counter-affidavitreferred to above and the submission of the learned counselfor the petitioners, the Writ Petition is disposed of asinfructuous.

As a sequel, interim order dated 13-4-2011 is vacatedand WPMP No.11828/2011/2011 and WVMP No.3250/2011are disposed of as infructuous.
