ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C.seeking anticipatory bail for the petitioner/A2 in Cr.No.107/2007 on thefile of Samisragudem Police Station, West Godavari District, registeredfor the offences punishable under section 420 of IPC.
Heard the learned counsel appearing for the petitioner/A2 andthe learned Additional Public Prosecutor, representing the State.
Learned Additional Public Prosecutor submits that in thepresent crime charge sheet was filed and the same was numbered asCC.433/2009 pending on the file of Judicial Magistrate of First Class,Nidadavolu, and the trial Court issued non-bailable warrant against thepetitioner/A2 on the ground that he was absconding.
According to the learned counsel appearing for thepetitioner/A2, the petitioner/A2 is not aware of the aforesaid casepending against him.
In any event, since the trial Court issued non-bailable warrantagainst the petitioner/A2, the petitioner/A2 is directed to approach thetrial Court and file a petition to recall the non-bailable warrant pendingagainst him, and the trial Court, on such petition being made, shallconsider and dispose of the same on the same day itself.
The Criminal Petition is accordingly disposed of.
