ORDER:

This writ petition is filed seeking a declaration that the action ofthe respondents in seizing the vehicle of the petitioner vide VehicleCheck Report No.17527, dated 18-10-2006 as arbitrary and illegal.

It is pleaded by the petitioner that the vehicle in question is aPower Triller which is used as Goods Carrier for carrying the goods forshort distances and the value of the same is Rs.10,000/. It is alsopleaded that the allegations under the vehicle check report are withoutany basis and as a matter of fact the petitioner possesses all therelevant documents.

Having regard to the specific case of the petitioner and havingregard to the nature of the allegations, it would be appropriate for therespondent to consider the request of the petitioner for release of thevehicle pending enquiry. However, it appears that no applicationseeking release of the vehicle has been made before the respondentso far.

In the facts and circumstances of the case, I deem itappropriate to dispose of the writ petition granting liberty to thepetitioner to make appropriate application before the 1[st] respondent forrelease of the vehicle in question, in which event the same shall beconsidered and appropriate orders be passed in accordance with lawwithin a period of one week thereafter. No costs.
