THE HONOURABLE SRI JUSTICLE J. CHELAMESWARANDTHE HONOURABLE SRI JUSTICE D. APPA RAOW.P. NO. 24915 of 2006

O R D E R(per Hon’ble Sri Justice D. Appa Rao)

This is a taken-up matter upon a letter dated 17.11.2006 by thepetitioner Machavaram Vijaya to issue a Writ of Mandamus directingthe respondents to protect her and her husband from her father andother relatives.

2) She averred in her letter to the Hon’ble The Chief Justice thatshe fell in love with one Suresh Babu and married him at SriPrasanna Venkateswara Swamy Temple, Konda Bitragunta village,Bogole Mandal, Nellore District on 12.11.2006 as per Hindu Law andCaste custom against the wishes of their parents. She came to knowthat her parents lodged a false complaint against her husband allegingthat he kidnapped her and took her away without her consent. Therefore, she apprehends threat to her and her husband’s safety.

3) First respondent, the Station House Officer filed counter, interalia stating that no complaint as alleged in the letter was received fromthe parents of the petitioner. In fact, she sent a similar letter to theSuperintendent of Police, Nellore District, who in turn referred it to him,and that he on enquiry came to know that no complaint was lodged. He further stated that every protection would be given as and whenthey approach him.

4) Since no complaint whatsoever was made by either of theparents to the police, the apprehension of the petitioner has no basis.

At any rate, the 1[st] respondent has undertaken to give all protection ifany complaint is received against them. We do not see any justifiableground to issue any direction in this regard.

5) In the circumstances, the Writ Petition is dismissed. No costs.
