ORAL ORDER:

W.P.No.8291 of 2006

This writ petition is filed seeking a Mandamus declaring the action of therespondents in not releasing the vehicle of the petitioner bearing No.AP 27 V 8727as arbitrary and illegal.

There is no necessity of going into all the details.

It appears, the vehicle of the petitioner bearing No.AP 27 V 8727 was seized by thesixth respondent through impugned order and kept in the custody of fifth respondent.

It is the contention of the learned Government Pleader that the rice meant for food forwork programme was diverted to black market in the vehicle belonging to thepetitioner, therefore, the same was seized and pursuant to the order of this Court inW.P.M.P.No.10592 of 2006 dated 23.5.2006, the vehicle of the petitioner hasalready been released on furnishing bank guarantee.

In view of the same, the cause in the writ petition does not survive for adjudication, therefore, the writ petition is dismissed as infructuous and the authorities are atliberty to proceed with the matter as per law and pass appropriate orders, ifnecessary. No order as to costs.
