ORDER:

Heard the learned counsel appearing for the petitioners/A-2 & A-3 andthe learned Additional Public Prosecutor representing the State.

This criminal petition is filed under Section 438 of the Code of CriminalProcedure seeking anticipatory bail to the petitioners.

It is submitted by the learned counsel appearing for the petitioners thatthe second petitioner/A-3 was arrested after filing of the present petition, therefore, the petition against him became infructuous and is accordinglydismissed.

The first petitioner/A-2 is a lady aged about 50 years. Though A-1 whois the son of the first petitioner is the prime accused in this case, there arecertain allegations against the first petitionerA/2 to the effect that she wasthreatening the de facto complainant by sending E.Mails to leave the houseand if she failed to leave the house, she would file a case.

From the contents of the F.I.R. it seems that the first petitioner wasabetting the commission of the offence. Therefore, I am not inclined to grantanticipatory bail to the first petitioner/A2.

Hence, the petition is dismissed.
