ORDER:

The petitioner, who was employed as a Driver in the APSRTC, was retired onmedical grounds, through order, dated 20.10.2005. The petitioner states that therespondents are under obligation to provide him alternative appointment interms of Section 47 of the Persons With Disabilities (equal opportunities, protection of rights and full participation) Act, 1995 (for short ‘the Act’) as wellas the Circulars issued by the Corporation. He states that the respondentshave not taken any steps for implementation of the same.

Heard the learned counsel for the petitioner and the learned Standing Counselfor the respondents.

It is true that the Corporation framed certain schemes, for the purpose ofproviding rehabilitation or employment, as the case may be, to the drivers, whoare retired on medical grounds. The liability under the Act is another aspect ofthe matter, which needs to be considered. The record does not disclose thatthe petitioner has made any representation in this regard.

Hence, the Writ Petition is disposed of, leaving it open to the petitioner to submit a representation to the respondents, seeking necessary relief. As andwhen such a representation is made, the respondent shall pass appropriateorders thereon, within a period of three (3) months from the date of presentationof the same. There shall be no order as to costs.
