This contempt case is filed complaining that therespondents have deliberately and intentionally disobeyed theorders of this Court dated 27-4-2012 in WPMP.No.15702 of 2012in W.P.No.12528 of 2012.
The aforesaid orders of this Court have been made absolutetoday i.e., 28-12-2012 in WVMP.No.2018 of 2012. As it is statedthat the petitioner took the treatment in Ayurveda and joined theduty, the question of referring him to the Ayurveda Hospital at thisJuncture does not arise and the question of his entitlement for thesick leave for getting the treatment and for all consequentialbenefits, requires to be decided in the main writ petition.
Therefore, we take the lenient view and accordingly thecontempt case is closed. However, the petitioner may make arepresentation before the Railway Authorities to consider his casefor entitlement of sick leave and consequential benefits as primafacie this Court while making the interim stay absolute observedthat there was no justification on the part of the Chief MedicalSuperintendent of the Railway Hospital in refusing to take theAyurveda Medicine. No costs.
