ORDER:
This contempt case was instituted alleging disobedience to the orderdated 14.03.2011 passed by this Court in W.P.No.16134 of 2005. By the saidorder, the A.P. State Wakf Board, the 1[st] respondent in the writ petition, wasdirected not to treat the petitioner’s land admeasuring Acs.4.58 cents inSurvey No.613/2 of Moolasagaram Village, Nandyal, as wakf land on thebasis of the Gazette Notification dated 02.05.1963/24.10.1963, in the light ofthe final and binding findings in A.S.No.152 of 1968 on the file of the learnedDistrict Judge, Kurnool.
The case of the petitioner, as reflected in the affidavit filed in support ofthis contempt case, was that notwithstanding the above order, the A.P. StateWakf Board and its officers continued to treat the subject property as wakfproperty as borne out by the records maintained by the Wakf Board as well asits website.
The contempt case was admitted on 11.09.2012. Sri M.A. Ghaffar,Chief Executive Officer, A.P. State Wakf Board, presented himself before thisCourt and undertook to comply with the orders of this Court. Thereafter, affidavits were filed by the said officer stating to the effect that the website hadbeen altered insofar as it pertains to Kurnool District so that the property ofthe petitioner was not reflected as a wakf property online. However, the A.P.State Wakf Board would have to delete only the specific item of thepetitioner’s property from its website instead of deleting the entire districtaltogether which would send out wrong signals as to the status of wakfproperties in the Kurnool District. It is now stated by way of an affidavit thatthe A.P. State Wakf Board has also informed the Commissioner, NandyalMunicipality as well as the registration authorities viz., the Sub-Registrar,Nandyal, that the petitioner’s property is not a wakf property. In the affidavitdated 26.12.2012 filed by the present Chief Executive Officer, A.P. StateWakf Board, the above facts were reiterated and it is stated that thepetitioner’s property has been deleted from the office record maintained bythe A.P. State Wakf Board and a letter in this regard has also been addressedto the Tahsildar, Nandyal, for the purpose of facilitating necessary entriesbeing made in the official records of the revenue department.
In the light of the aforestated developments, this Court finds thatsufficient steps have been taken by the A.P. State Wakf Board to comply withthe order passed by this Court. This contempt case is accordingly closed. No order as to costs.
