JUDGEMENT:
1. This appeal has been filed [by the ][appellanUdefendant]challenging the Decree [and ][Judgment ][dated ][30.07.2024 ][in ][A'S']No.200 of 2024 [passed by ][the ][ll ][Additional Chief Judge, ][City ][Civil]Court, Hyderabad.

2. Heard Mr.K.Rama Chandra, [[learned counsel ][for ][the]][[for ][the]][[the]]appellanVdefendant [and Mr. ][Nazir ][Ahmed Khan, learned ][counsel]for the respondenVPlaintiff.
3. The case of the appellanUdefendant [in ][brief ][is ][that' ][the]respondenVplaintiff filed a suit [vide ][OS ][No.2906 ][of ][2019 ][seeking]eviction of the defendant from [the ][suit schedule ][property ][and ][for]mesne profits. The trial Court [after ][inquiry ][decreed ][the ][suit ][and]directed the defendant to [handover ][the vacant ][possession ][of ][the]suit schedule [property ]to the [respondenUplaintiff ][within ][a ][period of]one month. l\ggrieved thereby, [the ][appellanVdefendant ][preferred]the appeal vide A.S.No.2O1 of [2024. ][lt ][is ][averred ][that, ][during]pendency of the appeal, an application in l.A. No.2696 of 2024 [was]filed seeking early hearing of the appeal suit. [The ][Appellate ][Court]on 3O.O7.2O24 advanced the appeal suit [and ][by ][observing ][an]
undertaking of the appeflant in the memo, dismissed the appeal asnot pressed.appeflant in the memo, dismissed the appeal asnot pressed.
4. Learned counsel for the appellanUdefendant would contend that though the petition for advancing the appeal suit was filed, theCourt below erred in dismissing the appeal as not pressed.Nonetheless, fairly admitted that in the affidavit filed by theappellanUdefendant before the Appellate Court, it has beenmentioned that the mafter was setfled, as the respondenUplaintiffgranted three (03) months of time in vacating the premises and forpas$ng necessary order. lt is contended that the appellanUdefendant was unaware of such entries in the affidavit and theAppellate Court without considering the merits, simply dismissedthe appeal suit as not pressed. Thus, prayed for interference.

Admittedry, the appeilant/defendant in lA No.26g6 0f 2024filed the affidavit stating settiement between himserf and therespondenUplaintiff herein ln such situation, the Appellate Courtdismissed the appeal as not pressed is found perfecfly justified andno impropriety or iflegarity is found in arriving such concrusion.However, the appellanUdefendant is resisting on the ground ofmischief in preparation of affidavit. \1While pleading so, the fact of settlement [mentioned in the affidavit ][has ][not ][been ][disputed' ][Even]otherwise, [plea ][of ][fraud ][or ][misrepresentation ][or ][misstatement ][may]to [fresh cause of ][action ][for ][appropriate ][legal ][recourse']gives rise but does [not ][giving rise ][to ][any ienable ground' much ][less ][any]substantial [question ][of law for ][consideration ][in ][the Second ][Appeal']
7. For ther [aforesaid, ][this ][aPPeal][ is ][liable ][to ][be ][and ][is]accordingly [dismissed. ][No ][order ][as ][to costs]
