W.P.No. 27687 of 2005
:O R D E R:
The three petitioners claim to be the owners and pattadars of lands inLakkappannapali H/o Kaki, Rolla Mandal, Anantapur district. They alleged thatrespondent Nos. 2 to 4 are trying to lay a road across the fields of the petitionerswithout due process of law. They, therefore, seek inter alia a direction to therespondents not to interfere with their possession.
At the stage of admission itself, learned Assistant Government Pleader for Revenue(General), after obtaining instructions from the respondents, submits that the DeputyExecutive Engineer (Panchayat Raj) has sent proposals for acquiring part of thepetitioners’ lands and that necessary steps are being taken for acquiring the landunder the Land Acquisition Act, 1894. He further denies the allegation that the roadis being laid across the field without due process of law. In view of the submission ofthe learned Assistant Government Pleader, it appears, the writ petition is filed onmere apprehension.
Accordingly, the writ petition is dismissed with the above observations. Nocosts.
