ORDER:

This writ petition is filed by a student, seeking todeclare the action of respondents in not admitting her intoM.B.B.S. course, as per the rank secured by her in theCommon Entrance Test i.e. EAMCET, 2010.

The petitioner has appeared in the CommonEntrance Test for entry into medical stream for theacademic year 2010-2011 and secured 40[th] rank. As perthe rules of admission, the candidate should complete 17years of age as on 31.12.2010. According to the entriesmade in the school records, the date of birth of thepetitioner is 6[th] January 1994, thus, when she was notgiven admission on the ground that she was under-aged,though she was eligible for admission as per the ranksecured by her, she has filed this writ petition.

This Court, while issuing notice before admission, taking into account the pendency of application of thepetitioner for correction of date of birth in S.S.C. records, passed orders in W.P.M.P.No.23125 of 2010, directing therespondents to consider the case of the petitioner foradmission into M.B.B.S. course. It is stated that pursuantto the interim orders of this Court, the case of the petitioner was considered and she was admitted into OsmaniaMedical College, Hyderabad, and she is pursuing thecourse, but the admission of the petitioner was notapproved in view of pendency of proceedings before thisCourt.

The learned counsel for petitioner has produced acopy of the proceedings, dated 18.06.2010, issued by theAdditional Joint Secretary to the Director of GovernmentExams in Rc.No. 133/02-02/2010, ordering forcorrection of date of birth of the petitioner from 6[th] January1994 to 6[th] December 1993. Accordingly, correctionswere also carried out in the Board of SecondaryEducation Certificate and the corrected copy is alsoplaced on record.

As much as the correction is already carried out inthe school records and now as it is confirmed that the dateof birth of the petitioner is 6[th] December 1993, she isfulfilling the eligibility criteria. Further, taking into accountthe fact that the petitioner is already admitted into M.B.B.S.course pursuant to the interim orders of this Court, this writpetition is allowed, directing the respondents to approvethe admission of the petitioner in M.B.B.S. course andallow her to complete the course, if such admission isotherwise in accordance with rules. No order as to costs.
