THE HON’BLE SRI JUSTICE SANJAY KUMAR
WRIT PETITION No.42674 of 2015
ORDER:
The petitioner – society applied to the National Council forTeacher Education (NCTE) for permission to offer a two year D.El.Ed.course from the academic year 2016-2017.
By order dated 17.11.2015, the NCTE rejected the petitioner-society’s application on the ground that it had failed to file a hardcopyof the application within the stipulated timeframe. Perusal of this orderreflects that an appeal is provided thereagainst under Section 18 of theNational Council for Teacher Education Act, 1993.
As an efficacious alternative remedy is provided by the statuteitself, this Court is of the opinion that it would not be open to thepetitioner – society to invoke its extraordinary jurisdiction by way of awrit petition in the first instance.
In that view of the matter, the writ petition is disposed ofpermitting the petitioner – society to present an appeal in accordancewith law within two weeks from the date of receipt of a copy of thisorder. In the event such an appeal is filed, the appellate authority shallstrive to dispose of the same expeditiously and in any event, not laterthan four (4) weeks from the date of receipt of such appeal.
Pending miscellaneous petitions, if any, shall stand closed inthe light of this order. No order as to costs.
