3. With the )onsent of learned counsel for the [pelitioner ][and]leamed Governn ent Pleader, the Writ [Petition ][is ][disposed ][c ][I ][at ][the]admission stage.

Learned G lvernment [Pleader appearing ][for ][respondent Nos'1]and 2 submits thar [the above said ][vehicle is ][seized ][in connection ][with]offence under ser [tion 420 IPC ][and Section 7 ][0fthe ][Act ][and ][therefore]direction [given ][by this ][Court ][should ][be to ][the]any 2nd respondent, u [ho ][upon ][petitioner ][satisffing ][the conditions' ][would]direct the 3.d [res ][londent ][for ][release ][of ][the ][said ][vehicle ][since ][it ][is]the [s ][at-e ][custody ][of ][the ][3'd ][respondent ][in conncction ][with]placed under Cr.No.244 of [2021registered ][for ][the under ][offence ][under Section 420]IPC and Section [7 ][ofthe ][Act.]
5. Insofar as release of [vehicle ][is ][concerned, ][enquiry ][under]Section 6-4 of [the ][Act, ][1955 ][and ][investigation/prosecution ][into ][the]crirne, if any, registered [against ][petitioner ][may take considerable ][time']Meanwhile, as [the ][vehicle ][is ][kept ][in ][the ][open ][yard ][exposed ][to ][sun and]other weather conditions [and ][kept idle, ][road worthiness ][of ][the ][vehicle]affected' [At ][the ][same ][time, ][as ][the ][vehicle ][is ][involved]rnay be severely in a crime and [violated ][statutory regulations, ][it ][cannot ][be handed ][over]to the owner [even ][before ][proceedings are ][concluded' ][Such ][course]the [offender ][to ][commit further ][offences ][and ][is ][not ][in]may bolster public interest.
6. Accordingly, [In ][view of ][the ][same ][and ][having ][regard ][to ][the ][facts]and circumstances [of ][the ][case, ][following ][directions ][are ][issued ][on]motor [vehicle of ][the ][petitioner:]releasing the (a) The petitioner shall [furnish fixed ][deposit ][receipt ][as ][proof]of opening of [fixed ][deposit account ][lor ][50% ][of ][the]amount of the [value ][of ][the ][vehicle ][as ][assessed ][by ][the]Assistant Motor [Vehicle ][lnspector/or bank ][guarantee ][for]the equal sum;of opening of [fixed ][deposit account ][lor ][50% ][of ][the]amount of the [value ][of ][the ][vehicle ][as ][assessed ][by ][the]Assistant Motor [Vehicle ][lnspector/or bank ][guarantee ][for]the equal sum; (b) The petitioner shall furnish an [undertaking ][in ][writing ][that]he will not alienate [or ][change the ][physical ][features ][of ][the]vehicle and shall [produce ][the ][vehicle ][as ][and ][when]directed by the [competent ][authority;]he will not alienate [or ][change the ][physical ][features ][of ][the]vehicle and shall [produce ][the ][vehicle ][as ][and ][when]directed by the [competent ][authority;]
