The pre',ent writ appea-l is arising out [ol the ][order ][dated]O1.11.2021 lassed by the [learned Single ][Judge ][in]W.P.No.2233l of 2O2l [.]

The un< isputed facts of the [case ][reveal ][that ][earlier ][a]writ petition i.e., W.P.No.15855 [of ][2021 was ][preferred ][by]Syyed Fasiud lin, who has [preferred ][the ][present ][writ ][appeal,]in respect of ;r contract which [he ][was executing ][i.e., contract]for collection of 17 items of [offeriags ][in ][Dargah ][l{azrall:-]Jahangir Peeran [(R.H.) ]for an amount [of ][Rs. ][1,50,00'O0O/-.]The contract was to expire on [11.08.2021 ][and ][the ][writ]petitioner, wh r was executing the contract, [has ][stated ][before]this Court sta ting that he has [suffered ][loss ][and ][tl-rerefore, ][he]should be co rtinued to work, [in ][spite ][of ][the fact that ][the]contract has :ome to an end [on ][1 ][i.08.202 ][1. ]['l'he ][learned]Single Judge ras disposed [of ][the ][writ ][petition, alter ][hearing]the parties at ength, [by ][an ][order ][dated ][72 ][OB'2O2': ][']

Leamed counsel for the [petilioner ]submits [that due ][to]preuailing pandemic s'iluation and the ban imposed [on ][opening ]ofDargals, there uere no Lasitors to the Dargah [and ][therefore,]petitioner has incuned huge loss. He furlher submits that euenthough fresh tender notifi.cation was Jloated, but there was [no]response and as of nou), no new contractor is selected. [He]tllerefore, submits that [petittoner ]maA be perlnitted [to ]continue [to]work as contractor for collecting 17 items of offeings [giuen ]bg [the]devotees Jor furtler period.

5. Learned Standing Counsel for tlLe Wakf Board submits thateuen ttaugh tender notificatton was floated., but it is not finalizedds tllere u)as no response and agrees for continuing the [petitioner,]provided. he accepts for increa.sing tLte tender ualue bg atleast150,6.

6. Leamed counset for the petitioner submits that 15o/o [mag ][be]on higher side and petitioner is uilling to increase ttLe uolume ofamount bg 10%. The amount collected in this manner is [required]to be utilised for prouiding amenities to the deuotees uht utsit theDargah. Therefore, I deem it reasonable to direct tlle petitioner topag 15ok more than agreed amount for the previous contractpeiod. Therefore, subject to petitioner paAing 15",6 more than theamount agreed Jor the preuious contracl leriod, the respond.ent-Board shatl continue the seruices of petitioner as contractor till aneu tender is floated and a new controctor is setected. It is opento the petitioner to patlicipate tn the tender [process ]as and uhentender nottfcation is issueri.

7. With the aboue obseruations, the Writ Petition is dtsposedof- Pending miscellaneous [petitions, ]if ang, [sLnll ][stand closed."]

The aforesaid order makes it very clear that the [learned]Single Judge has permitted the writ petitioner therein tocontinue to collect the amount in respect of offerings, [subject]to payment of 15% more than the tender value and it [was ][also]made clear that the arrangement made by the learned SingleJudge wiil continue till a new tender is floated and a [new]contractor is selected. A liberty was also granted to thepetitioner therein to participate in the tender process.

After the aforesaid [order was ][passed ][by ][the ][learned]Single Judge, [.he ][Telangana State ][Wakf Board, ][bY ][an ][order]dated 27.08 .2'121, [has ][extended ][the ][contract ][by ][one ][year']even though [tl tere ][was ][no ][such order ][passed ][by the ][learned]Single Judge t') [grant ][extension ][by ][one ][year' ][It ][is unfortunate]that in absenc: [of there ][being ][an ][order ][for ][extension ][for ][one]year, the Teli ngana State [Wakf Board ][has ][extencled ][the]contract bY on: Year.

Euen though the learned counsel appeaing on behatf ofrespondent No.S as tuell as learned Standing Counsel appearingfor [respondent ][Nos.2 ][to ][4 ]tried to deJend the ord.er impugned in thepresent Writ Petition, a conjoint reading of the order dated12.08.2021 passed by this Court in Wit petition No.1S8S5 of 2021and the order impugned herein shou.ts that the Court has onlgdirected the Wakf Board to continue the petitioner till a new tenderi.s Jloated and a neut contractor is selected.. Though th.e samecannot be construed o,s gtuing a mmplete go_bg to the tend.erprocess, respondent No.2 granted ertension of contract for a perbd.of one Aear. As seen from ttle record., respond.ent No.S has soughlefiension for onlg stx monfhs.6. Hauing regard. to the aboue, this Wit petition is alloued.and tlrc impugned order is set aside giuing liberty to respondentNo.2 to call for tenders afresh for tfLe peiod Jrom January, 2022.

The learned Single Judge, as the tender process wasgiven a complete go-by and the extension was granted for aperiod of one year contrary to the order passed in the earlierround of litigation, has directed the Telangana State WakfBoard to call for fresh tenders in the matter.

In the considered opinion of this Court, as transparentprocess has to be adopted by the Telangana State Wakf Boardfor allotting the work of collection of 17 items of offerings inDargah Hazrath Jahangir Peeran (R.H.) and the same cannotbe done without calling for tenders and without following due/process of law, this Court does not find any reason to \
