THE HON’BLE SRI JUSTICE RAJA ELANGOCRIMINAL PETITION No.13715 of 2015

ORDER:

This Criminal Petition is filed by the petitioner-accused No.2under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.370 of2010 on the file of Golconda Police Station, Hyderabad, registered forthe offence punishable under Section 382 IPC.

Heard and perused the material available on record.

The allegation against the petitioner is he, along with other twopersons, snatched away the gold chain of the de facto complainant.

Learned counsel for the petitioner submitted that the petitionerwas arrested in similar cases and subsequently, he was released onbail, and he was falsely implicated in the present case, which is similarto the earlier crimes.

Learned Public Prosecutor objected for grant of bail to thepetitioner on the ground that the charge sheet in the present case isnot yet filed and custodial interrogation of the petitioner is necessary.

Considering the submission of the learned Public Prosecutor, this Court is not inclined grant anticipatory bail to the petitioner.

Accordingly, the Criminal Petition is dismissed.
