ORDER:

The petitioner is accused of offences punishableunder Sections 403, 405, 408, 409, 463, 477-A, 420/34IPC and Section 79 (a) of the A.P. Co-Operative SocietiesAct, along with A1.

A1 is President of Kalipatnam Primary AgriculturalCo-Operative Credit Society Limited. A2 was the then in-charge Secretary of the said Society. Though severalallegations are made against A1 in the report given byDivisional Co-Operative Officer, Bhimavaram, theallegation against A2 is to the effect that he and A1colluded and sanctioned SAO loan to the extent ofRs.25,000/- on 19-07-2006 to one JakkamsettiSeethabhai on the basis of fabricated death certificate.

Having regard to the said allegation, I am of theopinion that the petitioner is not entitled for anticipatorybail until the said amount of Rs.25,000/- along with interestis made good to the society. Till date, the said amount isleft un-paid to the society.

Hence, the criminal petition is dismissed. Thepetitioner is at liberty to renew his application foranticipatory bail on making good the said amount ofRs.25,000/- along with interest to the society.
