ORDER:-
The petitioner is the sole accused in Cr.No.386 of 2012 ofKhanapuram Haveli Police Station, registered for the offence underSection 376 of I.P.C.
The accusation made g the petitioner is that he committed rapeon the victim woman, aged about 65 years, on 6-12-2012.
Heard learned Counsel appearing for the petitioner and learnedAdditional Public Prosecutor appearing for the respondent – State.
It is contended by the learned Counsel appearing for thepetitioner that the petitioner has been in judicial custody since 11-12-2012 and police completed major part of the investigation andtherefore further detention of the petitioner is not warranted.
Learned Additional Public Prosecutor opposed the applicationon the ground that investigation is pending.
As seen from the material placed on record, the incident is statedto have taken place on 6-12-2012 at about 1500 hours and reportcame to be lodged by the victim woman on 7-12-2012. Investigation isstated to be pending. In that view of the matter, I am not inclined togrant bail to the petitioner at this stage. However, the petitioner is atliberty to renew his request for grant of bail as soon as theinvestigation is completed.
Accordingly, Criminal Petition is dismissed.
