ORDER:

This writ petition is filed by the petitioner seeking a Writ ofMandamus to declare the action of the respondents ininterfering with its cultural and recreational activities and in notallowing its members to play the game of rummy (13 cards) incards room, as illegal and arbitrary.

·

2Without going into the merits of the case, the matter can bedisposed of at the stage of admission, as it is agreed by thelearned counsel for the petitioner as well as the learnedGovernment Pleader appearing for the respondents that theissue involved in this writ petition is squarely covered by anorder of this Court in Writ Petition No.16394 of 2009, dated11.08.2009. The operative portion of the order reads asfollows:

·

"Every club maintains a card roof and themembers of the clubare allowed to play game called 'Rummy' with 13 cards, which isconsidered to be a game of skill but not a game of choice. So long asthe members of the club paly any game of skill, they shall not beprevented from playing such games. It is only when the members playgames of choice, then, it shall be objected to and the police got a right tostop such illegal activities.

In that vew of the matter, the respondents are hereby directednot to interfere with the activities of the petitioner so long as it continuesits activities in games of skill. But, however, if it is noticed that themembers of the petitioner are indulging in games of choice, then thepolice can definitely interfere with such activities.

With the above observations, the writ petition is disposed of.".

·

3Accordingly, this writ petition is disposed of. No costs.
