THE HON’BLE SRI JUSTICE L.NARASIMHA REDDYWRIT PETITION No.27818 of 2011

ORDER:

The petitioner joined the course of B.B.A., LL.B. (Hons) in the 1[st] respondent – institution, in the academic year 2011-2012. On acomplaint submitted by his classmate, the 2[nd] respondent and herfather, the institution got the matter enquired into, and passed an orderdated 01.10.2011, suspending the petitioner for a period of one year. The said order is challenged in this writ petition. It is stated that theallegations made against him are not true and that the institution haspassed the order without giving him an opportunity of being heard.

Heard learned counsel for the petitioner and learned StandingCounsel for the 1[st] respondent.

The 1[st] respondent is a private educational institution. Thepetitioner does not complain of violation of any specific provision oflaw. Therefore, there is serious doubt as to the very maintainability ofthe writ petition.

Be that as it may, the allegations against the petitioner areserious in nature. Not only the 2[nd] respondent, but also her fathercomplained against the petitioner on number of occasions. Even ifpart of the allegation is found to be correct, stringent action needs to betaken against the petitioner. No exception can be taken to theimpugned order.

The writ petition is accordingly dismissed. There shall be noorder as to costs.

The miscellaneous petition filed in this writ petition shall standdisposed of.
