THE HON’BLE SRI JUSTICE C. PRAVEEN KUMARCRIMINAL PETITION No.15986 of 2014
ORDER:
The petitioner, who is the sole accused in Crime No.196 of2014 of Wadapalli Police Station, Nalgonda District, filed thepresent application under Section 438 Cr.P.C. seeking release inthe event of his arrest in connection with the above crimeregistered for the offences punishable under Section 354(a) IPC,Section 3(i)(x) of the Scheduled Castes & Scheduled Tribes(Prevention of Atrocities) Act and Section 10 of the Protection ofChildren from Sexual Offences Act, 2012.
The case of the prosecution is that on 17.12.2014 theinformant lodged a report stating that the daughter of his uncle byname Nenavath Laxmi was studying 8[th] class in Telangana StateTribal Welfare School at Damaracherla. On 14.12.2014 when theinformant went to the school and enquired said Nenavath Laxmiabout her studies, she stated that the principal of the school, thepetitioner herein, has been misbehaving with her and her schoolmates by using un-parliamentary language and touching theirprivate parts. Thereafter, though the petitioner was warned, therewas no change in his behaviour. Basing on these allegations, theabove report came to be lodged.Heard the learned counsel for the petitioner and the learnedAdditional Public Prosecutor.
Having regard to the allegations made in the report, which inmy view prima facie constitute the offences alleged, and since theoffences of this nature are grave and serious affecting the mindsetof the children, who are studying in the school, and also that ofparents, I am not inclined to grant anticipatory bail to thepetitioner.
Accordingly, the Criminal Petition is dismissed.
