Counsel for the petitioner : Smt.K.V.Rajashree Counsel for respondent No.2 : Sri S.V.Bhatt 28[th] December, 2006

Per G.S. SINGHVI, C.J.

In this petition, the petitioner has prayed for issue of a direction torespondent Nos.1 and 2 to take action in the matter of pollution causedby tyre retreading unit being operated by respondent No.3 in theresidential area.

We have heard Smt. K.V.Rajashree, learned counsel for thepetitioner and Sri S.V.Bhatt, learned counsel for the Andhra PradeshPollution Control Board (for short, ‘the Board’) and perused the record.

Admittedly, the Board has already issued notice dated 29-9-2006 to respondent No.3. In this view of the matter, we feel that endsof justice will be served if a direction is issued to the Board to passappropriate order in accordance with law within a period of two monthsfrom the date of receipt of copy of this order. Ordered accordingly. However, it is made clear that no action prejudicially affectingrespondent No.3 shall be taken and no order be passed against itwithout giving the said respondent proper opportunity of hearing.

The writ petition is disposed of in the manner indicated above.

As a sequel to disposal of the writ petition, WPMP.No.34651 of2006 filed by the petitioner for interim relief is disposed of asinfructuous.
