ORDER:

·

This writ petition is filed by the petitioner seeking aWrit of Mandamus to declare the action of respondents 1to 3 in not taking action against the 4[th] respondent, who isaccused No.3 in Crime No.123 of 2009, as illegal and arbitrary.

·

22. According to the petitioner, he lodged a complaintwith the 3[rd] respondent against the 4[th] respondent andtwo others on 10.11.2009. On the basis of the complaint, the 3[rd] respondent registered a case in Crime No.123 of2009 against the accused therein for the offences underSections 307, 324 and 506 IPC. Though the 3[rd]respondent registered the crime on 10.11.2009, he hasnot taken any action against the 4[th] respondent so far. Being aggrieved by the same, he approached this Courtand filed the present writ petition.

·

3. Heard both the learned counsel.

·

44. When once a crime is registered, the police are dutybound to investigate into it and submit a final report beforea competent criminal court. As seen from the FIR, it isclear that it is more than a month since the date ofregistration of the crime i.e. 10.11.2009. It is true that itwould take some more time for the 3[rd] respondent tocomplete the entire investigation, but at the same time heshall see that the investigation is completed, at theearliest. In the light of the same and as it is the grievanceof the petitioner that the 3[rd] respondent has not yet takenaction to arrest the 4[th] respondent, this court is of the viewthat this writ petition can be disposed of with a direction torespondents 1 to 3 to complete the investigation.

·55. Accordingly, this writ petition is disposed ofdirecting respondents 1 to 3 to complete the investigation and file a final report, as provided for under Section 173Cr.P.C. before a competent criminal court, preferably, within a period of two (2) months from the date of receiptof a copy of this order. There shall be no order as to costs.
