COMMON ORDER:
These two writ petitions are filed challenging the action of therespondents in appointing officials to take charge of the VanaSamarakshna Samatis. According to the petitioners, they are entitledto manage the affairs of the Samitis till the elections to the ManagingCommittee are held.
Respondents 1 and 2 have filed counter-affidavits, inter alia, stating that with the expiry of term of the elected body of the petitioners, the Managing Committee has no right to continue in office.
Heard learned counsel for the petitioners and learnedGovernment Pleader for Forests.
It is not in dispute that the term of the Managing Committee of thepetitioners-Samiti is three years from the date of election and that thesame had expired in the year 2005. Though the petitioners contendthat they are entitled to continue in office till the next committee iselected, no rule or provision of law is placed before this Court. In theabsence of any such provision, the elected body shall cease tofunction on expiry of its term. At any rate, the elections have sincebeen held and new committees were appointed.
Therefore, nothing remains to be decided in these writ petitionsand they are accordingly dismissed as infructuous. There shall be noorder as to costs.
