This writ petition has been filed for issuance of a writ in thenature of Mandamus for staying the operation and implementation of theimpugned order dated 19.11.2018 (Annexure P-1), passed by respondentNo. 2 — Deputy Commissioner, Palwal, whereby the petitioner has beenordered to be removed from the post of Sarpanch, till the decision of theappeal along with stay application dated 27.11.2018 (Annexure P-2), filedby the petitioner along with appeal pending betore FinancialCommissioner-cum-Additional Chief Secretary, Department of Panchayatand Rural Development, Haryana.
Learned counsel for the petitioner, at the very outset, restrictshis arguments to the extent that a direction be issued to FinancialCommissioner-cum-Additional Chief Secretary, Department of Panchayatand Rural Development, Haryana to decide the application for stay, filedalong with the appeal.
In view of the above, this petition is disposed of with adirection to Financial Commissioner-cum-Additional Chief Secretary, CWP No. 40630 of 2018
Department of Panchayat and Rural Development, Haryana to decide theapplication for stay, filed along with the said appeal, on 09.01.2019 orwithin a period of three days thereafter.
Till the time Financial Commissioner-cum-Additional ChiefSecretary, Department of Panchayat and Rural Development, Haryanalpasses an order, the petitioner shall not be divested of the charge of the postof Sarpanch.
