HON’BLE SRI JUSTICE V.V.S.RAO

ORDER:

WRIT PETITION No.26031 of 2006

The petitioner is a resident of Potlapudi Village of Tota PalliGudur Mandal in Nellore District. He alleges that his father,Vepakomma Ramaiah, filed an application for ryotwari patta underSection 11(a) of the Andhra Pradesh (Andhra Area) Estates (Abolitionand Conversion into Ryotwari) Act, 1948, before the AssistantSettlement Officer, Nellore, and that the latter, after conducting enquiry, issued ryotwari patta vide S.No.129/11(a)/63/NLR, dated 05.01.1966. It is his case that after the death of his father he is in occupation andenjoyment of the property. Besides making number of applications, the petitioner allegedly approached the Mandal Revenue Officer, thirdrespondent herein, on 04.01.2006 requesting for issue of pattadar passbooks and title deeds, in vain. Therefore, the present Writ Petition isfiled seeking a direction to the third respondent to issue pattadar passbooks and title deeds.

The matter was heard at preliminary stage on 15.12.2006 andwas adjourned to enable the learned Assistant Government Pleaderfor Revenue (General-A) to get instructions. Today after gettinginstructions, the learned Assistant Government Pleader submits thatthe patta submitted by the petitioner was verified and it was found thatthere is no corresponding record in relation to S.No.129/11(a)/63/NLR,and that the Assistant Settlement Officer never issued any such patta. He also submits that the pattas issued to other persons were verifiedby the respondents and it was found that the signature of the AssistantSettlement Officer is not tallying with the signature of the Officer whosigned the patta granted to the petitioner. He, however, does not dispute that the Mandal Revenue Officer has not yet passed any orderto that effect.

Therefore, giving liberty to the Mandal Revenue Officer to passappropriate orders within a period of four weeks from the date ofreceipt of a copy of this order, the Writ Petition is disposed of, withoutexpressing any opinion on the merits of the case. No costs.
