Seeking a writ of Mandamus declaring the order dated 22.11.2007 made in TMP No.276/2007 in TA No.
751 of 2006 by the 3[rd] respondent herein, directing paymentof 50% of the disputed tax as a condition precedent for grantof stay for the remaining amount and interdicting theCommercial Tax Department from recovering the disputedtax during pendency of the appeal, as illegal and arbitrary,the petitioner filed this writ petition.
When this writ petition is taken up for hearing, it issubmitted by the learned counsel for the petitioner thatsimilar matter has already been decided by this court inW.P. No. 27885 of 2007 and 28115 of 2007 on 28.12.2007,which is not disputed by the learned Special StandingCounsel for Commercial Taxes.
Following the same, this writ petition is also disposedof in terms of the order in WP No. 27885 of 2007 and 28115of 2007 dated 28.12.2007. No order as to cost.
