O R D E R:
Heard learned counsel for the petitioner and learnedGovernment Pleader for Civil Supplies.
Petitioner assails the proceedings dated 7.11.2015of the second respondent directing the interim disposalthrough public distribution system of ‘Redgram dal’, otherpulses and oil seized from the petitioner’s Kirana storespursuant to an inspection done on 5.11.2015.
Counsel for the petitioner states that none of thestocks seized from the petitioner’s business premiseswere likely to decay and there was no necessity to directinterim disposal of the same under Section 6-A (2) of theEssential Commodities Act, 1955.
Learned Government Pleader for Civil Suppliesdoes not dispute this fact.
Therefore, pending disposal of 6-A proceedingsagainst the petitioner, stocks seized from the petitioner’spremises shall not be disposed of. The said proceedingsshall be completed as expeditiously as possible, preferably within a period of four months from the date ofreceipt of a copy of this order.
The Writ Petition is disposed of with the aboveobservation. There shall be no order as to costs. As asequel thereto, miscellaneous petitions, pending if any, shall stand closed.
