Aggrieved by the order dated O2.O3.2O2O in E.p.No.g3 of2018 in A.B.R/C.F.No .5O2 of 2OlZ passed by the Court of learned ISenior Civil Judge, City Civil Court, Hyderabad, the present CivilRevision Petition is filed.2018 in A.B.R/C.F.No .5O2 of 2OlZ passed by the Court of learned ISenior Civil Judge, City Civil Court, Hyderabad, the present CivilRevision Petition is filed.

E.P.No.83 of 20lg is hled by respondent No.1/Decree Holderherein under Order XXI Rule 4g of CpC against Judgment DebtorNos.2 to 5 for attachment of their salaries to recover the Epamount of Rs.I0,77,961/_ basing on the decree in Dispute No.SO2of 2017. The trial Court after hearing both sides allowed theExecution Petition and ordered torSS1lEsalary attachmentwarrants against Judgment Debtor Nos.2 to 5 under Order XXIRule 48 on process subjected to Section 60 of CpC. Aggrieved bythe said order, petitioners/Judgment Debtor Nos.2 to 4 filed thepresent Civil Revision petition.

3. Heard Sri V. V. Rama Krishna, learned counsel for therevision petitioners as well as Sri N. Srikanth Goud, learnedcounsel appearing on beharf of respondent No.1/Decree Horder.

4. Learned counsel for the petitioners submitted that thoughthe E.P. is filed for an amount of Rs. 10,7 Z,96l /- but the trial (

Court issued warrant for an amount of Rs. 13,20,3431-, which isagainst the process of law.

5. On the other hand, learned counsel for the respondentswould submit that respondent No.1 herein filed Execution petitionclaiming an amount of Rs. 10,77,967 /- and. there is no request inthe petition with regard to the subsequent interest and theyadmitted that Execution Petition is only for an amount ofRs.tO,77,961 /-.

6. Having regard to the rival submissions made by both thelearned counsel and having gone through the material available onrecord, the Execution Petition is hled for an amount ofRs.lO,77 ,961 /- whereas the warrant is issued for an amount ofRs. 13,20,343/- which is against the order of the trial Court.

7. Accordingly, this Civil Revision petition is allowed settingaside the warrant in E.P.No.83 of 2018 in A.B. R/C.F.No.SO2 of2017 passed by the learned I Senior Civil Judge, City Civil Court,Hyderabad. There shall be no order as to costs.
