The preserrt [writ ][appeal ][is ][arising ][out ][of ][order ][dated]14.06.2021 [pass:d ][in ][W.P.No'14926 ][of ][2O2O ][by the ][Learned Single]Judge The undis cuted [facts ][of ][the ][case reveal ][1:har ][the ][writ]petitioners have larticipated [in ][the ][process ][of selection ][pursuant ][to]the notificatior dated [31.05.2018 ][issued ][by the ][present]appellants/ resp( ndents in the [main ][writ ][petition ][in ][respect ][of ][as]many as 1370 ['acancies, ]The facts [further ][reveal ][that ][after ][the]process of selec [ion was concluded, large number of [candidates]have not [joined ]he posts at ail and those posts are not being filledup by the per ions, who have participated in the process ofselection, keepi rg in view their placement in the process ofselection.

Learned cr unsel for the State Government a s r.i,ell as theTelangana State Level Police Recruitment Board have rehementlyargued before tL Ls Court that in case a person has not joined, thevacancy has to b: carried forward to the next selection.

The facts < I the case make it very clear that it is not a casewhere appointm )nt orders were issued, persons have joined thepost and persor s have left thereafter. Whetiter compliance of Rule 6-A of the Rules has been doneor not has to be looked into in each and every individua.l case,The learned Singie Judge has a.lso gone to the extent in holdingthat the vacancies which are lying even after issuance ofappointment orders, meaning thereby on account of non-joining ofthe candidates, are to be {illed up in accordance with Rule 6(A) oftl-re Rules. However, Rule 6 of the Rules provides that in case acandidate does not join pursuant to issuance of appointmentorder, the fallout vacancies, if any, due to relinquishment andnon-joining of selected candidates shall be nolilied in the nextrecruitment. Therefore, to that extent, the order [passed ]by [the]learned Single Judge is contrary to the [statutory provisions ][as]contained in Rule 6 ofthe Rules.

Resultantly, the order passed by the [learrred ][Single ][Judge is]set aside. The matter is remanded back to [the ][writ ][court to ][deal]with each. and every individual [writ ][petition, ][in ][order ][to ][give ][a]finding of fact whether Rule [6(A) ][of ][the ][Rules ][has ][been complied]with or not. The [parties ]sha-lI [appear before ][the ][learned ][Single]Judge on 29.10.2021. [The learned ][Singie ][Judge ][is ][requested to]decide the matters [as expeditiously ][as possible, ][preferably urithin]a period of thirty [days ][from today, keeping ][in ][view ][the ][fact ][that ][t}te]p"titiott"r" *" irr-tt it [g ]against [time and ][by ][efflux of ][time' ][their]iight to the [post ][will ][come ][to an end']

In the c rnsidered [opinion ][of ][this ][Court, ][keeping ][in ][view ][the]aforesaid [judl;ment, ]once a [vacancy ][is ][advertised ][and ][the ][vacancy]is unfiIled, ar the person in whose favour appointment [order ][has]been issued I.as not [joined, ]the same cannot carry iorward to [the]next selectior L. The next person in the waiting iist should beappointed a lainst the vacancy. However, in cases whereappointment orders were issued, persons have joined and leftthereafter, th,:n the particular vacancies have to be carried forwardto the next s:lection and therefore, this Court does not find anyreason to in1 :rfere with the order passed by the learned SingleJudge.

Accordir gly, the writ appeal is dismissed.
