HON’BLE SRI JUSTICE C. PRAVEEN KUMAR
WRIT PETITION No. 21506 OF 2011
ORDER:
Heard learned counsel for the petitioners and learned GovernmentPleader for Revenue. With the consent of both parties, the present writpetition is disposed of at the admission stage itself.
The present Writ Petition came to be filed seeking to declare theaction of the respondents in forcebily taking over petitioners’ plots bearingNos.1 to 4 in Survey No.175 of Rekurthi Village, Karimnagar Mandal andDistrict, as illegal and arbitrary.
Though various grounds are raised in the writ petition, learnedcounsel for the petitioners restricts his prayer seeking a direction to theDistrict Collector to pass appropriate orders on the representation dated15.02.2009, made by the petitioners to provide alternate land or paycompensation at the prevailing price as per law. Learned GovernmentPleader for Revenue does not dispute the same. However, he submits thatif the said representation is still pending, the respondents may be directedto dispose of the same, in accordance with law.
Without going into merits of the case and having regard to therequest made by the petitioners, the District Collector/respondent No.1shall dispose of the representation dated 15.02.2009, made by thepetitioners, as early as possible, preferably within a period of twelve (12)weeks from the date of receipt of a copy of this order, in accordance withlaw, if the same is still pending. It is needless to mention that it will beappropriate if an opportunity of hearing be given to the petitioners at thetime of disposal of the representation.
Accordingly, the writ petition is disposed of. No costs.
Consequently, the Miscellaneous Petitions, if any, pending in this writpetition shall stand closed.
