ORDER:

THE HON’BLE SRI JUSTICE L. NARASIMHA REDDYCONTEMPT CASE No.1578 of 2010

The petitioners filed W.P.No.28080 of 2009 for a declarationthat the action of the respondents in treating the land admeasuringabout Acs.9.00 in Survey Nos.153/1, 153/3 and 154/1 ofParadesipalem Village, Visakhapatnam Rural Mandal,Visakhapatnam District as Government land as illegal, arbitraryand unconstitutional. They have also sought a direction to therespondents therein to issue pattadar pass books in their favour inrespect of the said land. The writ petition came up for hearing on18.01.2010. This Court took note of the orders passed by theRevenue Divisional Officer, Visakhapatnam as regards theclassification of the land and held that the land can no longer betreated as the one belonging to the Government. A Direction wasissued to the Tahsildar, Visakhapatnam Rural Mandal, the solerespondent herein, to issue pattadar pass book to the petitionerswithin two months from the date of receipt of a copy of the order. This contempt case is filed stating that the respondent has notcomplied with the orders of this Court.

The Tahsildar, Visakhapatnam Rural Mandal, byname Sri Peddi Raju, the respondent herein, filed a counter-affidavit stating inter alia that a letter has been addressed to theDistrict Collector, Visakhapatnam seeking further directions and inthe process, the delay had occurred.

Heard Sri P.Laxma Reddy, learned counsel for thepetitioners and the learned Government Pleader for Revenue.

During the course of hearing of the contempt case, thisCourt took serious exception to the attitude exhibited by theTahsildars, who worked at Visakhapatnam Rural Mandal eversince this Court passed the order. At a time when the contempt case was about to be allowed, the learned Government Pleadersought for time, so that he can take up the matter with the higherauthorities in the Revenue Department. Today, he has placedbefore this Court a set of papers evidencing the correspondenceand the result thereof. On the directions issued by the CCLA, thetwo Tahsildars, namely Venkateswar Rao and Peddi Reddy areplaced under suspension, pending disciplinary proceedings. Withthis, the grievance of the petitioners stands redressed.

Both the Tahsildars have filed affidavits tendering apology. The same is accepted and the contempt case is closed taking alenient view of the matter.
