THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA ANDTHE HON’BLE SRI JUSTICE SANJAY KUMAR

Writ Appeal No. 2028 of 2013

Judgment:(per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta)

The impugned order has been passed by the learned Single Judgewhile granting interim relief on an interlocutory application filed by theappellants-petitioners.

However, it is not as per the choice of the appellants. We are ofthe view that considering the prima facie case and balance ofconvenience, the learned Single Judge passed just and appropriateorder. We, therefore, do not like to interfere with the same. However,we request the learned Single Judge to decide the writ petitionexpeditiously.

The appeal is accordingly dismissed.

Consequently, the miscellaneous applications, if any, shall standdismissed. No costs.
