ORDER:
This Transfer Civil Miscellaneous Petition is filed under Section 24C.P.C. to transfer O.P.No.53 of 2011 on the file of the Court of Senior CivilJudge, Medak to the file of Judge, Family Court, City Civil Court, Hyderabadfor trial and disposal along with O.P.No.1596 of 2011 on the file of the latterCourt.
The petitioner and the respondent are wife and husband. Thepetitioner filed O.P.No.1596 of 2011 on the file of the Court of Judge, FamilyCourt, City Civil Court, Hyderabad for the dissolution of marriage betweenherself and the respondent whereas the respondent filed the O.P. forrestitution of their conjugal rights before the Court at Medak.
It is pleaded in the petition that the petitioner is residing at Hyderabadwhich is far away from Medak. According to her she has to take her childrento school and bring them back. Further she has been depending upon herparents for her livelihood as she got no means to maintain herself and herchildren. Therefore, she pleads that it is difficult for her to attend the Court atMedak and also bear necessary traveling expenditure from Hyderabad toMedak.
Heard both sides.
I am satisfied with the pleas made by the petitioner.
In the circumstances stated, the Tr.C.M.P. is allowed transferringO.P.No.53 of 2011 on the file of the Court of Senior Civil Judge, Medak tothe file of Judge, Family Court, City Civil Court, Hyderabad for trial anddisposal along with O.P.No.1596 of 2011 on the file of the latter Court.Miscellaneous petitions pending, if any, shall stand closed.
