ORDER:

This Writ Petition is filed for a Mandamus to declarethe action of respondent No.2 in initiating proceedingsunder Section 6-A of the Essential Commodities Act, 1955(for short ‘the Act’) against the petitioner.

Having regard to the allegations on which theproceedings under Section 6-A of the Act have beeninitiated against the petitioner, I decline to interdict thesame. However, the petitioner has pleaded that thoughher authorization has not been suspended and only ashow cause notice was issued by respondent No.3 on27.11.2014, respondent No.4 has stopped allotting theessential commodities to her for distribution.

At the hearing, learned Assistant GovernmentPleader for Civil Supplies (Andhra Pradesh), has stated that he has no instructions as to whether the petitioner’sfair price shop authorization has been suspended or not.In the light of the facts pleaded by the petitioner, respondent No.4 is directed to continue allotment of theessential commodities to the petitioner’s fair price shop fordistribution so long as her authorization remains in force. Subject to the above direction, the Writ Petition isdisposed of.

As a sequel to disposal of the Writ Petition,WPMP.No.51191 of 2014 filed by the petitioner for interimrelief is disposed of as infructuous.
