...RESPONDENTS

ORDER:

This Writ Petition is filed by the petitioner seeking writ ofmandamus declaring the action of the respondents in not re-valuing his B.A., undergraduate course single subject ‘English’papers III and IV of the examination held by Dr.B.R.Ambedkar OpenUniversity, Hyderabad, for the III year (term) in November, 2003, asillegal and arbitrary.

It is submitted that accepting the request of the petitioner therespondent-University itself has undertaken revaluation andcommunicated vide proceedings No.90/Dr.BRAOU/Exams/03-04,dated 03-03-2004, intimating that there is no change in the result evenafter revaluation of papers applied for.

Though it is further submitted by the learned counsel for thepetitioner that the answer scripts may be called for to verify the samebut when it is stated in the counter affidavit that the revaluation wasundertaken as requested by the petitioner and there is no change in theresult even after revaluation, there appears no ground at all to call forthe answer scripts by this Court to examine the same in exercise of thepowers under Article 226 of the Constitution of India. Writ Petition isdevoid of merits and is liable to be dismissed.

Accordingly the Writ Petition is dismissed. No order as to costs.
