WRIT APPEAL NO.1165 OF 2010

JUDGMENT: (per the Hon’ble the Chief Justice Shri Nisar AhmadKakru)

The appellants - petitioners claiming to be the tree pattadars inrespect of the land in question sought a restraint to be placed upon therespondents from preventing them to enjoy the possession of the land. Several opportunities were granted to the appellants – petitioners toproduce the tree pattas but failed to, leaving no option for the writ courtbut to consider the matter on the basis of material available whichunveils specific denial by the respondents about grant of pattas to theancestors of the appellants – petitioners and absence of evidence muchless admissible in law resulted in denial of relief by the writ court. Wefind no fault with it. Dismissed.
