ORDER:(Per Hon’ble Ms. Justice G.Rohini)
This Writ Petition is filed assailing the action of the 1[st] respondent – Bank in issuing the sale notice, dated 15.10.2013 forsale of the secured assets under the provisions of the Securitisationand Reconstruction of Financial Assets and Enforcement of SecurityInterest Act, 2002.
When the matter is taken up for consideration, it is brought toour notice by the learned counsel for the 1[st] respondent – Bank thatthe sale as proposed under the impugned notice was not held on22.11.2013 for want of bidders and no fresh sale notice has beenissued so far.
Under the circumstances, the cause in the Writ Petition does notsurvive and accordingly, the same is dismissed. However, this shallnot preclude the petitioner to institute fresh proceedings in casenecessity thereof arises. No costs.
Consequently, Miscellaneous Petitions, if any, pending in thisWrit Petition shall stand closed.
