….RESPONDENTS

THE HONOURABLE SRI JUSTICE C.V.RAMULU

W.P.No.16294 of 1996

ORDER:

This writ petition is filed seeking a Mandamus declaring the action ofthe respondents in not regularizing the services of the petitioner including theperiod of suspension from 22-8-1984 to 24-7-1992 as arbitrary and illegal.

It appears the petitioner was appointed as a contingent staff with the3[rd] respondent college with effect from 2-7-1979. Thereafter, his serviceswere ratified on 20-09-1983 by the Director of Higher Education. Thereafter, petitioner was suspended in view of certain allegations against him witheffect from 22-8-1984 and though the suspension was lifted on 18-1-87, he was not permitted to join duty. However, on filing W.P.No.12479of 1991 he was permitted to join duty on 24-7-1992. Though the petitioner iscontinuously working since 2-7-1979 his services are not regularized andaccording to the petitioner he is entitled for regularization of his services inthe cadre of Class-IV employees of the 3[rd] respondent college whileadmitting the post held by the petitioner to grant-in-aid.

There is no necessity of going into all the details. It appears thatduring the pendency of the writ petition, the 3[rd] respondent already sentproposals for regularization of the services of the petitioner in the Class-IVpost and further sent proposal to the 2[nd] respondent i.e., by proceedingsdated 4-7-2001. According to the learned counsel for the petitioner theproposals sent by the correspondent of the 3[rd] respondent dated 4-7-2001 tothe Commissioner and Director of Collegiate Education, A.P., Hyderabadhave not yet been disposed of. Under those circumstances, the 2[nd]respondent is directed to consider and dispose of the proposals sent by thecorrespondent dated 4-7-2001, if not, already disposed of within a period ofeight weeks from the date of receipt of a copy of this order. Further therespondents may also consider regularizing the period of suspension from22-8-1984 to 24-7-1992. However, during the pendency of suchconsideration, the service of the petitioner shall not be disturbed. With the above direction, the writ petition is disposed of. No order asto costs.
