THE HON’BLE Ms. JUSTICE G. ROHINIWRIT PETITION No.13449 OF 2006

ORAL ORDER:

The Special Deputy Collector (Tribal Welfare),Rampachodavaram, having initiated the proceedings under theprovisions of the A.P. Scheduled Areas (Land Transfer) Regulation 1of 1959 (for short “Regulation 1 of 1959”) in respect of the land to anextent of Ac.6.61 cents situated in Sy.No.51 of Patha RamavaramVillage, Gangavaram Mandal, East Godavari District passed ordersdated 29.5.2006 directing ejectment of the petitioner under Section3(2) of Regulation 1 of 1959. Questioning the same he preferred anappeal before the 1[st] respondent. He also sought for stay of operationof the order dated 29.5.2006 till the disposal of theappeal. However, the 1[st] respondent-appellate authority, failed toconsider the same and, in the meanwhile, the 3[rd] respondent is takingsteps to dispossess the petitioner in execution of the order of ejectmentdated 29.5.2006. Hence, this writ petition.

Heard the learned counsel for the petitioner and the learnedGovernment Pleader for Social Welfare, appearing for respondents 1to 3.

Since, admittedly, statutory appeal against the order of the 2[nd]respondent dated 29.5.2006 is pending before the 1[st] respondent, itwould be appropriate to maintain status quo obtaining as on today tillthe statutory appeal is disposed of.

Accordingly, without expressing any opinion on merits, the writpetition is disposed of with a direction to the 1[st] respondent to disposeof the appeal pending on its file as expeditiously as possiblepreferably within a period of 3 months from the date of receipt of thisorder. Till such time, the order of Status Quo granted by this Court dated 6-7-2006 shall continue. No costs.
